nondisclosure typeqIn Canada, people living with HIV/AIDS (PHA) may be charged with a crime if they don’t disclose their status before doing anything that poses a reasonable risk of HIV transmission. In 1998, the Supreme Court ruled in R v. Cuerrier that nondisclosure prosecutions would benefit public health while not affecting HIV testing rates; however, the courts didn’t base their decision on any evidence.
